Refund Policy for Sketch My Roof, INC: Due to the rapid processing of our sketch services, no refunds are available once an order has begun processing. It is crucial that you verify the accuracy of the location and ensure that you are ordering a sketch for the correct property before completing your purchase.
Delivery Notification Policy: Sketch My Roof, INC. delivers all completed sketches directly to your account dashboard, where they are available for download immediately upon completion. Email notifications are provided as a courtesy to inform you that your order is ready, but they are not the delivery method itself. Missed, delayed, or undelivered email notifications, including emails routed to spam, junk, promotions folders, or blocked by a client’s email provider or firewall, do not constitute a failure of delivery and do not warrant a refund. It is the client’s responsibility to check their account dashboard for order status. Sketch My Roof, INC. is not responsible for third-party email delivery issues, client-side email filtering, or any client decision to redraft or reorder work without first verifying order status in their account.
Third-Party Software Compatibility and User Responsibility: Our products are fully compatible with third-party programs such as Verisk/Xactimate® and CoreLogic/Symbility®. However, a lack of user knowledge or technical proficiency in operating these respective programs, including but not limited to importing, exporting, or writing estimates, does not qualify as grounds for a refund of our product. We suggest users learn how to import, export, and create estimates in their chosen program before purchasing our report.
Chargeback Policy and Theft of Services Notice:
1. Chargeback Policy: By placing an order with Sketch My Roof, INC, you agree to our pricing, terms of service, and refund policies. We are committed to providing accurate and timely services, and we expect that any concerns or disputes will be addressed directly with our customer service team. Attempting a chargeback without first seeking resolution with our team is a violation of our Terms of Use. If you have any billing disputes, please contact us immediately so we can resolve the issue.
2. Theft of Services and Legal Action: We take fraudulent chargebacks seriously and view them as theft of services. If you attempt to obtain our services without payment, or if you file an unjustified chargeback, we will pursue legal action. This includes, but is not limited to, filing a theft of services case against you for any nominal amount stolen. Furthermore, you will be responsible for reimbursing all legal fees, court costs, and expenses incurred by Sketch My Roof, INC as a result of any fraudulent chargeback or attempted theft of services.
3. Additional Fees for Chargebacks: If a chargeback is initiated, Sketch My Roof, INC incurs a $17 dispute fee for each occurrence. In accordance with our terms, you are responsible for reimbursing both the original cost of goods and the $17 dispute fee.
4. Our Right to Recover Payments: Additionally, if payment for our services cannot be resolved amicably, Sketch My Roof, INC reserves the right, at our discretion, to contact the homeowner, insurance company, Independent Adjusting (IA) firms, or the Department of Insurance in the state where the service was requested to recover the owed amount. This may include pursuing payment directly from these parties for the services rendered.
Accuracy of Information: Please take extra care to confirm that the location pin is accurately placed on the intended property. In the event that a sketch is created for an incorrect location due to the misplacement of the location pin by the client, a redrafting fee will be incurred for any necessary corrections.
Quality Assurance: In the unlikely event there are any concerns with the quality of a sketch, Sketch My Roof, INC. strives to provide high-quality sketches and is committed to rectifying any issues. We reserve the right to make any necessary corrections to meet your satisfaction.
Incorrect Product Orders: If a customer orders the wrong product or service, no refund will be granted once the service has been rendered. It is the customer’s responsibility to ensure they are selecting the correct product for their needs. We recommend double-checking all order details prior to submission to avoid any issues.
Pitch Specification and Adjustment Policy for Roof Diagrams: Pitch is determined using the highest-quality tools at our disposal, but you may also specify the pitch when placing your order. All diagrams will be created based on the pitches you provide. If no pitch is specified, we will use our comprehensive range of views and pitch measurement techniques to construct the diagram as accurately as possible. Please note that if you require us to revisit the file to modify any pitches after it has been delivered, a fee of $10 will be applied to your account.
Warranty: The materials from Sketch My Roof, INC. are provided “as is,” and you use them at your own risk. Sketch My Roof, INC. offers no warranties or guarantees, either express or implied, concerning the content, quality, accuracy, completeness, effectiveness, reliability, or suitability of these materials for any specific purpose. Contractors should always carry out an initial site inspection to verify the details of the Roof Report provided. If an error is found in the report, we reserve the right to make corrections to ensure your satisfaction. If such an error leads to issues with material orders and is proven significant upon investigation, the sole remedy will be a refund of the fees you paid for that report.
Indemnification: You agree to indemnify, defend, and hold harmless Sketch My Roof, INC. (including its licensees, assignees, subsidiaries, affiliates, and their respective officers, directors, employees, shareholders, agents, and representatives) from any and all liabilities, losses, injuries, demands, actions, costs, expenses, or claims of any nature whatsoever, resulting from or related to your use or possession of the materials provided by us.
Limitation of Liability:
Scope & Limitation
Sketch My Roof provides preliminary roof measurements for estimating purposes only. Clients are responsible for verifying all dimensions before using them in any construction or claims process. Clients may not rely solely on these sketches for final planning.
Damages Cap
Client agrees that Sketch My Roof’s total liability shall not exceed the amount paid for the sketch regardless of damages claimed.
Exclusion of Damages
Sketch My Roof shall not be liable for any indirect incidental special punitive or consequential damages including lost profits loss of data or business interruption even if advised of the possibility of such damages.
Maximum Liability
To the fullest extent permitted by law Sketch My Roof’s total liability arising from or relating to this agreement whether in contract tort or otherwise is limited to the fees paid by Client for the sketch that gave rise to the claim.
Exceptions
This limitation does not apply to liability resulting from Sketch My Roof’s gross negligence or willful misconduct or to any liability that cannot be excluded under applicable law.
Termination: Your limited license to use the materials provided by Sketch My Roof, INC. will automatically end without notice if you violate any terms of this agreement. Upon termination, you must delete all digital copies and either destroy or return all physical copies of the materials, including any modifications or copies made from them.
